Terms of Service

These Terms of Service ("Terms") govern your access to and use of aiusage.ai (the "Service"), operated by AIUsage, a product of TreeCo Media LLC ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service Is

aiusage is a bring-your-own-key ("BYOK") proxy for the Anthropic Claude API. You supply your own Anthropic API key. We forward your requests to Anthropic on your behalf, applying infrastructure optimizations to reduce cost while preserving output quality. We do not sell access to Claude — Anthropic does. We sell the proxy service that sits in between.

2. Your Account

• You must be at least 18 years old to create an account.
• You must provide a valid email address and are responsible for verifying it.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity under your account.

3. Your Anthropic API Key

You retain full ownership of your Anthropic API key at all times. When you paste it into aiusage, we encrypt it at rest using AES-256-GCM on our servers and use it solely to forward your requests to Anthropic. You may delete or rotate your key in your dashboard at any time. We never transmit your decrypted key back to your browser after initial storage.

Your relationship with Anthropic is separate from your relationship with aiusage. You remain bound by Anthropic's Terms of Service and Acceptable Use Policy for all calls made through the Service.

4. Credits and Payment

• aiusage is usage-based. You purchase credits in packs and spend them as you make calls.
• Payments are processed by Stripe. We never store full card numbers.
• Credits are non-refundable except where required by law.
• Credits do not expire.
• Pricing is subject to change with at least 14 days' notice, applied only to future purchases — not existing balances.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any law, regulation, or third-party rights, including Anthropic's Acceptable Use Policy.
• Generate content that is illegal, deceptive, defamatory, or harmful to minors.
• Attempt to reverse-engineer, decompile, or circumvent the Service's infrastructure.
• Resell raw access to the Service without prior written agreement.
• Use the Service to create a substantially similar competing product.
• Send abusive traffic designed to degrade service for other users.

6. Service Availability

We target high availability but do not guarantee uninterrupted Service. We may schedule maintenance, investigate incidents, or throttle traffic at our discretion. We are not liable for Anthropic API outages, Stripe outages, or other upstream-provider failures.

7. Intellectual Property

The Service, including our infrastructure, dashboards, brand, and code, is owned by us. You get a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Content you send through the Service remains yours; we claim no ownership over your prompts, completions, or API responses.

8. Termination

You may cancel your account at any time by deleting your API key and closing your account. We may suspend or terminate your account if you violate these Terms, if payment fails, or if your activity threatens the stability or legality of the Service. On termination, any remaining credit balance may be forfeited where permitted by law.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT OUTPUT GENERATED BY CLAUDE THROUGH THE SERVICE WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to defend and indemnify us against any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced by updating the "Effective" date at the top and, where appropriate, by email. Continued use of the Service after an update constitutes acceptance of the updated Terms.
